Terms and Conditions of Service
This text governs the general terms of use of the digital forensics, data recovery, cybersecurity (penetration testing), KVKK consultancy, information security and DSET Academy training services provided by Doğanay Siber Emniyet Teknolojileri ("DSET"). Purchasing a service indicates acceptance of these terms.
1. Parties
- Provider: Doğanay Siber Emniyet Teknolojileri (DSET)
- Customer: the individual or corporate party requesting the service
2. Service Scope and Contract
All services are additionally initiated with an individual contract that is signed or electronically approved. In this contract:
- The scope and methodology are clearly stated
- The duration and delivery date are specified
- The fee and payment terms are explained
- Confidentiality (NDA) provisions are included
3. Data Recovery — Special Terms
- A free preliminary analysis is guaranteed — no processing begins without your approval
- There is no success rate guarantee. Data recovery depends on the degree of physical/logical damage
- After an approved quote, the processing fee may be charged as a labor cost even if the outcome is unsuccessful (clarified in the contract)
- After the service, the device is returned by hand or by courier. DSET is not responsible for loss in transit (insured shipping is recommended)
4. Digital Forensics — Special Terms
- The digital forensics report is delivered only to the requesting party (to the relevant authority if there is a court/prosecutor order)
- The chain of custody is recorded with a report
- The report is in the nature of an expert opinion; the court's final discretion is reserved
- Information is not given to persons who are not explicitly authorized
5. Cybersecurity / Pentest — Special Terms
- A penetration test does not begin without a written authorization document (RoE — Rules of Engagement). Systems outside the contract are not interfered with
- The customer accepts responsibility for short-term service interruptions that may occur during the test (this is rare; in most cases it goes unnoticed)
- Findings are reported only to the customer; DSET does not publicly disclose any finding / exploit
- A free re-test after remediation (within 30 days) is included in the contract
6. KVKK / GDPR Consultancy
- Consultancy is advisory in nature; the final legal interpretation belongs to the KVKK Authority
- At the end of the contract term, reports are delivered to the customer
- Annual audits and updates are carried out under a separate contract
7. DSET AI (Artificial Intelligence Assistant)
- The AI Chat on the website is for general information purposes and does not constitute an official opinion
- For urgent and critical situations (ransomware, data loss), a phone call is recommended
- AI outputs may not reflect DSET's official position; consult an expert for definitive information
- Chat records are deleted after 30 days (immediately upon request)
8. Payment and Termination
- The fee is as specified in the contract — in advance, in part or on delivery
- Bank transfer, credit card (e-collection) or cash is accepted
- If the customer terminates the contract before the service is delivered, a proportionate fee is charged for the work already started
- DSET reserves the right to unilaterally terminate the contract if the customer makes an unlawful request
9. Disclaimer of Liability
DSET cannot be held liable in the following cases:
- Additional damage occurring on a device the customer previously gave to another company
- Loss occurring during shipping processes (insured shipping is recommended)
- Non-acceptance of the digital forensics report by the court (the report is an expert opinion)
- Force majeure (earthquake, flood, terrorism, epidemic, internet outage)
10. Intellectual Property
The reports, training materials, code fragments and methodology documents prepared by DSET are the intellectual property of DSET. The customer has unlimited rights to use them for its own internal use, and limited rights to reproduce them.
11. Dispute Resolution
In disputes arising from this contract, the Ankara Courts and Enforcement Offices have jurisdiction. An amicable solution is sought first.
12. Changes
DSET reserves the right to update these terms at any time. Significant changes are announced via the home-page announcement banner.
